Air Passenger Rights


Passengers may be entitled to compensation if their flight has been delayed or cancelled

Travellers may be unaware of the rights they have and the compensation they may be owed by the airline in case of a disruptive delay or cancellation. Additionally, they may be entitled to compensation for denied boarding because of overbooking, as long as the passenger did not volunteer to give up the seat or for missing a connection flight because of a delay in the previous flight.

Passenger Rights in Europe: EC 261

For passengers that fly from or within the European Union are protected under Europe’s EC 261/2004 Law, which grants passengers a range of compensations in case of delays or cancellations that fall under the responsibility of the airline. That means that airlines are liable to pay financial compensations for passengers whose flight has been disrupted as long as it hasn’t happened due to extraordinary circumstances that could no be avoided by the airline, even if all reasonable measures were taken.

These extraordinary circumstances include political instability, security risks, unexpected flight safety shortcomings, strikes that affect the operation of an operating air carrier, or meteorological conditions that are incompatible with the operation of the flight.

Applicability

The EU 261/2004 Regulation and its passenger rights apply to flights that depart from the European Union. additionally, these rights also apply for flights into the EU, if airline that operates the flight is an EU carrier. 

Right to Care Under EC261/2004

Travelers are eligible for ‘Right to Care’ in the following scenarios:

  • A delay of 2 or more hours for flights up to 1,500 km.
  • A delay of 3 or more hours for EU flights over 1,500 km.
  • A delay of 3 or more hours for non-internal EU flights between 1,500 – 3,500 km.
  • A delay of 4 or more hours for non-internal EU flights over 3,500 km.

The EU 261 Regulation stipulates that travellers are entitled to: 

  • Meals and refreshments appropriate to the waiting time
  • Access to 2 free telephone calls, emails, or faxes.
  • In case a stay of one or several nights is necessary, the airline must provide hotel accommodation and transport to and from the hotel.
  • A refund and a return flight to the initial point of departure, if the delay is longer than 5 hours.

Compensation You are Entitled to Under EC261/2004

The EU 261 Regulation stipulates that the compensation you are entitled to varies depending on the flight distance and the total final delay at arrival. Hence:

  • Flights shorter than 1,500 km and a total final delay longer than 3 hours entitles you to  € 250.
  • Flights between 1,500 – 3,500 km and a total final delay longer than 3 hours entitles you to  € 400.
  • Flights longer than 3,500 km and a total final delay between 3 and 4 hours entitles you to  € 300.
  • Flights longer than 3,500 km and a total final delay longer than 4 hours entitles you to  € 650.
